Introduction

This agreement contains the complete terms and conditions that apply to you in joining, buying and all other activities you will make in our website https://admin.mtrlog.com or any sub-domain of mtrlog.com (referred to as “the MTRLOG site” for the remainder of this document). By using or shopping from the MTRLOG site, you agree to be bound by its terms of use and shall comply thereof. This agreement describes and encompasses the entire agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the MTRLOG site, the content and service provided by or through the MTRLOG site, and the subject matter of this agreement. Amendments to this agreement can be made and effected by us from time to time without specific notice to you. MTRLOG is part of RDXT Solutions AB.

Use of the MTRLOG site & prohibitions

The MTRLOG site allows you to subscribe to the MTRLOG service. However, you are prohibited to do the following acts: (a) use our sites, including its services and or tools if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from using our sites, services, or tools; (b) post false, inaccurate, misleading, defamatory, or libelous content.

For you to complete the sign-up process in our site, you must provide your full legal name, a valid email address, and any other information needed in order to complete the sign-up process. You must qualify that you are 18 years or older and must be responsible for keeping your password secure and be responsible for all activities and contents that are uploaded under your account.

Product pricing & descriptions

The price displayed for products on our website represents the recommended retail price listed on the product itself excluding any VAT and minus any shipping/delivery charges.

We do not warrant that product descriptions or other content of the MTRLOG site are error-free. If a product offered in our website is not as described, your sole remedy is to return it in unused condition to the retailer from which it was purchased.

Payments and processing of invoices

MTRLOG has the sole discretion to provide the terms of payment. Unless otherwise agreed, payment must first be received by MTRLOG prior to the latter’s acceptance of an order. Unless credit term has been agreed upon, payment for the products shall be made by credit card. Invoices are due and payable within the time period noted on your invoice, measured from the date of the invoice. An order may be invoiced separately. MTRLOG has all the discretion to cancel or deny orders. MTRLOG is not responsible for pricing, typographical, or other errors in any offer by MTRLOG and reserves the right to cancel any orders arising from such errors. Invoices must be paid within 30 days of the invoice date.

Refund policy

We do not have to provide a refund if you have changed your mind about a particular purchase, so please choose carefully. If the goods are faulty, we will meet our obligations under the applicable laws. Returns will be made via the retailer from which you purchased the MTRLOG device at fault. Please see the retailers terms and conditions for further details.

Shipping policy and prices

MTRLOG does not ship the MTRLOG hardware. All shipments/deliveries of hardware are made via our retail partners. MTRLOG deliver a digital service via the MTRLOG site which does not have any associated shipping costs.

Delivery time of product

For full details on the delivery time of the MTRLOG hardware, please see the retailer from which you have purchased the MTRLOG hardware. The MTRLOG service delivered through the MTRLOG site is delivered immediately upon a successful subscription payment unless otherwise stated.

Subscriptions

The MTRLOG service delivered through the MTRLOG site is a subscription based service. This means that to fully use the MTRLOG service you must have successfully purchased a subscription package from MTRLOG for each MTRLOG device you own.

Subscription packages can be paid monthly, quarterly (3 months) or yearly unless otherwise stated.

Subscription packages will be billed against your credit card with the amount stated at the time of purchase.

All subscription packages come with a 30 day free trial period unless otherwise stated.

An additional charge (€1), may be made upon adding a new payment method to verify validity of the payment method.

The subscription package will automatically renew every month, 3 months or year depending on which subscription package was purchased. Renewal will be billed against the payment method used for the first payment unless changed before the renewal date.

You may cancel your MTRLOG subscription at any time. In the event of cancellation, no refund will be made for remaining days left on the subscription package, however the MTRLOG service will continue to function until the end of the subscription period.

Subscription package prices and renewal prices are subject to change, but we will always notify you beforehand.

You may still login to the MTRLOG service without a valid subscription, however, any journeys made during the period which does not have a valid subscription will not be shown.

Editing, Deleting and Modification

We may edit, delete or modify any of the terms and conditions contained in this agreement, at any time and in our sole discretion, by posting a notice or a new agreement on our site. YOUR CONTINUED PARTICIPATION IN OUR SITE FOLLOWING OUR POSTING OF A CHANGE NOTICE OR NEW AGREEMENT ON OUR SITE WILL CONSTITUTE BINDING ACCEPTANCE OF THE CHANGE.

Acknowledgment of rights

You hereby acknowledge that all rights, titles and interests, including but not limited to rights covered by the Intellectual Property Rights, in and to the MTRLOG site, and that You will not acquire any right, title, or interest in or to the Program except as expressly set forth in this Agreement. You will not modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from any of our services, software, or documentation, or create or attempt to create a substitute or similar service or product through use of or access to the Program or proprietary information related thereto.

Fraud

Fraudulent activities are highly monitored on our site and if fraud is detected MTRLOG shall resort to all remedies available to us, and you shall be responsible for all costs and legal fees arising from these fraudulent activities.

Warranty disclaimer and limitations of liability

We will not be liable for indirect, special, or consequential damages, or any loss of revenue, profits, or data, arising in connection with this Agreement.

We make no express or implied warranties or representations with respect to any products sold and offered in our website ( including, without limitation, warranties of fitness, merchantability, non-infringement, or any implied warranties arising out of a course of performance, dealing, or trade usage). In addition, we make no representation that the operation of our site will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors. The MTRLOG site and its information, contents, materials, products and services are provided on an “as is” and “as available” basis. You and understand and agree that your use of the MTRLOG site is at your own risk.

Confidentiality

You agree not to disclose information you obtain from us and or from our clients, advertisers and suppliers. All information submitted to us by an end-user customer pursuant to a Program is proprietary information of MTRLOG. Such customer information is confidential and may not be disclosed. Publisher agrees not to reproduce, disseminate, sell, distribute or commercially exploit any such proprietary information in any manner.

Non-waiver

Failure of MTRLOG to insist upon strict performance of any of the terms, conditions and covenants hereof shall not be deemed a relinquishment or waiver of any rights or remedy that the we may have, nor shall it be construed as a waiver of any subsequent breach of the terms, conditions or covenants hereof, which terms, conditions and covenants shall continue to be in full force and effect.

No waiver by either party of any breach of any provision hereof shall be deemed a waiver of any subsequent or prior breach of the same or any other provision.

Miscellaneous

This Agreement shall be governed by and construed in accordance with the substantive laws of Sweden, without any reference to conflict-of-laws principles.

Any dispute, controversy or difference which may arise between the parties out of, in relation to or in connection with this Agreement is hereby irrevocably submitted to the exclusive jurisdiction of the courts of Sweden, to the exclusion of any other courts without giving effect to its conflict of laws provisions or your actual state or country of residence.

The entire agreement between the parties with respect to the subject matter hereof is embodied on this agreement and no other agreement relative hereto shall bind either party herein.

Your rights of whatever nature cannot be assigned nor transferred to anybody, and any such attempt may result in termination of this Agreement, without liability to us. However, we may assign this Agreement to any person at any time without notice.

In the event that any provision of these Terms and Conditions is found invalid or unenforceable pursuant to any judicial decree or decision, such provision shall be deemed to apply only to the maximum extent permitted by law, and the remainder of these Terms and Conditions shall remain valid and enforceable according to its terms.

Privacy Policy

This Privacy Policy governs the manner in which MTRLOG (part of RDXT Solutions AB) collects, uses, maintains and discloses information collected from users (each, a 'user') of the https://admin.mtrlog.com website ('Site'). This privacy policy applies to the Site and all products and services offered by MTRLOG (part of RDXT Solutions AB). We adhere to the General Data Protection Regulation ('GDPR') which is the data protection law that started in the EU on 25th May 2018. GDPR replaces the Swedish Data Protection Act (PuL). It is important for us that you as a user feel safe with how we handle your personal information. Therefore, we are open to how we collect, process and share the data about you.

Personal identification information

We collect personal identification information from you when you register on the site and in connection with the activities, services, features or resources we make available on the Site. You may be asked for, as appropriate, name, email address, mailing (billing) address, phone number, credit card information, social security number and company organisation number. We will collect personal identification information from you only if you voluntarily submit such information to us. You can always refuse to supply personally identification information, except that it may prevent you from engaging in certain Site related activities. We also collect location based information via the MTRLOG hardware.

Non-personal identification information

We collect non-personal identification information about users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about the means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.

Web browser cookies

Our Site may use 'cookies' to enhance your experience. Your web browser places cookies on your hard drive for record-keeping purposes and sometimes to track information about them. You may choose to set your web browser to refuse cookies, or to alert you when cookies are being sent. If you do so, note that some parts of the Site may not function properly. You are able to delete your own cookies and we do not store cookies outside of your browser.

How we use collected information

MTRLOG (part of RDXT Solutions AB) collects and uses personal information only for providing the MTRLOG service. We do not sell, trade, or rent your personal information to others. We use your personal information for the following purposes:

  • - To provide the MTRLOG service

    Location based information collected by the MTRLOG hardware is used only to provide you with the MTRLOG service; viewing an MTRLOG devices location in close to realtime and/or viewing the history of the MTRLOG devices location.

  • - To improve customer service

    Information you provide helps us respond to your customer service requests and support needs more efficiently.

  • - To personalize user experience

    We use information in the aggregate to understand how our users as a group use the services and resources provided on our Site.

  • - To improve our Site

    We use feedback you provide to improve our products and services.

  • - To process payments

    We use the information you provide when placing an order only to provide service to that order. We do not share this information with outside parties except to process the payment or make a delivery. We do not store any credit card numbers as these are processed and stored by the payment processor (either Stripe or Paymill).

  • - To send periodic emails

    We use your email address to send you information and updates pertaining to any orders. It may also be used to respond to your inquiries, questions, and/or other requests. If you decide to opt-in to our mailing list, you will receive emails that may include company news, updates, related product or service information, etc. If at any time you would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email or you may contact us via support@mtrlog.com.

How we store and protect your information

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.

Sensitive and private data exchange between the Site and its users happens over a SSL secured communication channel and is encrypted and protected with digital signatures.

Communication between the web servers (Site) and other services such as caches, databases, payment provider API's and location/mapping functions happens over a SSL secured communication channel and is encrypted and protected with digital signatures.

We store your personal information for 7 years or until you request it be removed. Personal information is stored for this long so that you can access your data if required even after ending your subscription with us. If you would like to remove your data and personal information at the same time as cancelling a subscription, please contact support@mtrlog.com.

Modification and removal of your personal information

You may modify any of the personal information collected at any time by logging in to the Site and visiting the relevant account pages. Modification and/or removal of your personal information and/or MTRLOG account in its entirety can also be done by contacting MTRLOG support at support@mtrlog.com.

Sharing your personal information

We do not sell, trade, or rent your personal information to others. We may use third party service providers to help us operate our business and the Site or administer activities on our behalf, such as sending out newsletters or surveys. We share only your email with these third parties for those limited purposes provided (i.e. sending email).

Changes to this privacy policy

MTRLOG (part of RDXT Solutions AB) has the discretion to update this privacy policy at any time. When we do, we will revise the updated date at the bottom of this page. We encourage you to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.

Your acceptance of these terms

By using this Site, you signify your acceptance of this policy and terms of service. If you do not agree to this policy, please do not use our Site. Your continued use of the Site following the posting of changes to this policy will be deemed your acceptance of those changes.
